Terms of Service
The terms under which Peak State Apps sells you a license for our products.
1. Operator
Peak State Apps (Adrian Scheibelhut, Germany — full address in the Imprint) is the operator and licensor for all products sold under the Peak State Apps name, including but not limited to NetGlobe (Chrome extension) and cardgate (Android app). All references to "we", "us", or "our" in these terms refer to Peak State Apps.
2. License grant
When you purchase a Peak State Apps product license, we grant you a non-exclusive, non-transferable, non-sublicensable right to use the software for personal or business use, on up to the number of devices stated at purchase. For NetGlobe Pro, the current device cap is 3 activations per license. Activations on additional devices require deactivating an existing one or purchasing a separate license.
You do not receive ownership of the software or any rights in its source code or copyrights. You may not redistribute, sublicense, sell, or rent the license itself or the software it unlocks.
Where source code is published (e.g. NetGlobe on GitHub), it is made available under the license stated in that repository. The license terms here apply to your purchased license — not to your separate use of any open-source code we publish.
3. Pricing and billing
Current prices for each product are shown at our checkout page (operated by Lemonsqueezy). Two pricing models are offered for NetGlobe Pro:
- Lifetime — a one-time payment that grants Pro access for as long as the product exists. Includes all future updates within the same major version.
- Monthly subscription — billed every month, automatically renewing until you cancel.
VAT or sales tax is added at checkout where applicable, based on your country of residence as reported by Lemonsqueezy. All payments are processed by Lemonsqueezy and Stripe; we never see your payment card details.
4. Refunds
We offer a 30-day money-back guarantee for first-time purchases of any Peak State Apps product. If the product doesn't work for you for any reason, email peakstate.apps@gmail.com within 30 days of your purchase and we'll issue a full refund. No questions asked.
Repeat purchases (e.g. you bought, refunded, then bought again on the same email) are at our discretion. We're not running a free-trial program through serial refunds — but a one-time genuine refund is always honoured.
For EU customers, this 30-day guarantee is offered in addition to any statutory rights you may have under EU consumer protection law. By starting to use the digital product (e.g. by activating the license in the extension), you acknowledge that you may lose your statutory 14-day right of withdrawal under § 356(5) BGB; our voluntary 30-day guarantee remains in force regardless.
5. Subscription cancellations
You can cancel a monthly subscription at any time:
- From the customer portal link in your purchase confirmation email (operated by Lemonsqueezy), or
- By emailing peakstate.apps@gmail.com from the address you used to purchase.
Cancellation takes effect at the end of your current billing period. You keep Pro access until then, and we don't pro-rate refunds for partially-used months. Once the period ends, the next renewal does not occur and the license re-validates as inactive on its next weekly check.
6. Warranty disclaimer
Our software is provided "as is", without warranty of any kind, express or implied. We don't guarantee that the software will be error-free, secure, available without interruption, or fit for any particular purpose.
Specifically for NetGlobe: geo-IP lookup results are approximate (sourced from third-party IP-to-location databases) and should not be used for any purpose where accuracy is critical (e.g. legal evidence, security investigations). Tracker categorisation is rule-based and may produce false positives or false negatives. The extension reads request metadata that Chrome chooses to expose; some traffic (notably HTTP/3 / QUIC streams in some Chrome versions) may not be observable.
Nothing in this section affects any non-excludable statutory warranty rights you have under your local consumer-protection law.
7. Limitation of liability
To the maximum extent permitted by applicable law, Peak State Apps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, or data, arising from your use of our software.
Our total cumulative liability to you for any claim arising from your purchase or use of a Peak State Apps product shall not exceed the amount you paid us for the relevant license in the 12 months prior to the event giving rise to the claim. For lifetime-license purchases older than 12 months, the cap is the original lifetime purchase price.
This limitation does not apply to (a) damage caused by gross negligence or wilful misconduct, (b) personal injury or death, or (c) any liability that cannot be excluded under applicable mandatory law (including, in Germany, the Produkthaftungsgesetz).
8. Acceptable use
You agree not to:
- Reverse-engineer, decompile, or disassemble the software, except where applicable law explicitly allows it (e.g. for interoperability under § 69e UrhG).
- Remove or alter copyright or licensing notices.
- Use the software to violate any applicable law or third-party rights.
- Share your license key publicly or with parties beyond the activation cap.
9. License revocation
We reserve the right to revoke a license without refund if it is fraudulently obtained (e.g. chargebacks, stolen payment methods) or used in violation of §8. In all other circumstances, your license remains valid for its stated duration.
10. Changes to these terms
We may update these terms occasionally. Material changes will be communicated via email to active license holders and reflected in the version number below. Your continued use of the product after such notice constitutes acceptance of the updated terms; if you don't accept them, the refund process in §4 is available within 30 days of the change for any active license.
11. Governing law and venue
These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law does not deprive you of the protection of any non-excludable provisions of the law of your habitual residence.
For non-consumer customers, the exclusive venue for any dispute arising from or in connection with these terms shall be the courts of Germany.
